Acceptance of terms
Sainsburyscontactlenses.co.uk is owned and operated by JSCL Limited ("JSCL"), a company registered in England and Wales with registered company number 5697944 whose registered office is at Atlantic House, Holborn Viaduct, London EC1A 2FG. JSCL is an approved trading partner of Sainsbury's Supermarkets Limited, a company registered in England and Wales whose registered office is at 33 Holborn, London EC1N 2HT ("Sainsbury's").
Please read this agreement carefully before using the Sainsburyscontactlenses.co.uk website ("Website"). They represent the terms and conditions ("Terms") for using and placing orders on the Website. Using our Website indicates that you accept the Terms. If you do not agree to these, then do not use our Website. You are permitted to use our Website solely on the basis of these Terms. JSCL reserve the right, at our discretion, to update and/or revise these Terms. Please check periodically for changes.
NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS.
THIS IS AN AGREEMENT BETWEEN YOU AND JSCL
1. Definitions
In these Terms, the following words and phrases will have the following meanings:
"Order" means a purchase order issued by you to us in accordance with these Terms in respect of Products;
"Products" means the products which we supply in accordance with these Terms;
"Order" means a purchase order in respect of the Products issued by you to us.
2. Use of this Website
2.1 So long as you do so in accordance with these Terms, you may view and download our Website for your personal use only. However, you must note that we may change, suspend or discontinue the Website or the provision of Products under the Website at any time, including the availability of any feature, database, or content. JSCL may also impose limits on certain features and services or restrict your access to parts or all of the Website without notice or liability.
2.2 You are responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access or otherwise use the Website, including, without limitation, modems, hardware, software, and long distance or local telephone service.
3. REGISTRATION & SECURITY
3.1 To participate in the Sainsbury's contact lenses online service, to place Orders and to receive Products via the Website, you must:
3.1.1 be 18 years of age or over;
3.1.2 have a valid credit or debit card in your name;
3.1.3 be resident (and remain resident) in the United Kingdom; and
3.1.4 complete our registration procedure in which you will need to provide us with various details and confirm that you have: (i) previously worn contact lenses; (ii) had a contact lens fitting with a qualified optician; and (iii) not experienced any problems from such use.
3.2 You must ensure that the details which you provide during registration or at any time after registration are correct and complete.
3.3 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in the "my account" area of the Website.
4. PRICES & PAYMENT
4.1 The prices which you must pay for the Products that you Order are set out on the Website at the time you place your Order (plus a delivery charge unless you place your Order via the online ordering process on the Website) except where we discover an error in the price of the Products you have ordered. In this event, we will inform you as soon as possible after receiving your Order and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled.
4.2 Prices shown on the Website are inclusive of VAT.
4.3 You will not be charged for items until we accept your Order immediately prior to despatch. However, please note that we may pre-authorise your Card payment at the time you place your Order with us. We may delay despatch until receipt of authorisation for payment to be taken from the payment card provided. You can pay by any Mastercard or Visa credit card, Switch or Delta debit card, Solo cards or Electron cards. Your credit/debit card details will be encrypted to protect your personal card information. It is your responsibility to keep your password secure. We reserve the right to modify or withdraw a password at our discretion.
5. ORDER & ACCEPTANCE
5.1 You may place Orders either (i) using the online process for ordering Products via the Website; or (ii) by calling our Customer Services by telephone on 0845 7078 332.
5.2 When you place an Order with us, we need to obtain various details from you so that we can process your Order. You must ensure that the details which you provide each time you place an Order are correct and complete. When you Order, you will need to have available a valid contact lens prescription which is not more than 12 months old and which has been issued to you by a registered optician ("Your Prescription"). The information which we will need during the Order process will include information from Your Prescription.
5.3 Once you have placed an Order to purchase a product from the Website you will receive an e-mail confirming receipt of your Order and the details of your Order.
5.4 After placing your Order, you must forward to us as soon as possible Your Prescription. This must not be a copy. We cannot progress your Order until we receive Your Prescription. Please note that we cannot accept liability if Your Prescription is lost in the post.
5.5 Upon receipt of Your Prescription, we shall verify the details you provided when you placed the Order with us. If we cannot verify your prescription, we will not be able to accept your Order and shall notify you of the same using the contact details you provided. Even where we are able to verify the details provided using Your Prescription, our acceptance of you Order will not yet have taken place.
5.6 We will retain Your Prescription following receipt unless you request we send it back to you. Where you make such a request, we shall forward Your Prescription via post. [Please note that we cannot accept liability if Your Prescription is lost in the post.]
5.7 Your Order is an offer to purchase Products from us, which is subject to our acceptance in accordance with these Terms. Our acceptance of your Order and the completion of the contract between you and us will take place upon despatch to you of the Products ordered and it is at this point that your payment card will be debited. Each separate supply of Products shall constitute a separate contract between us subject to these Terms.
5.8 Therefore all Orders are subject to verification, us receiving payment and also stock availability.
5.9 If the Products ordered are not available, you will be notified by our Customer Services department using the contact details you have provided and you will have the option either to (i) wait until the Products are available from stock; or (ii) cancel your Order.
5.10 Any offers for Products at discounted prices or with additional loyalty rewards, detailed on the Website, may be made available from time to time for you to Order (subject to our acceptance) for a limited period of time as stated in that offer.
6. DELIVERY
6.1 Delivery will be made to the address specified by you when you place your Order. This may vary from your payment card address, but please note that we can only deliver Products within England, Scotland, Wales and Northern Ireland. We cannot deliver to P.O Box addresses.
6.2 We will do our best to secure despatch within 24 hours of validating the details you provided with Your Prescription (as described in condition 5.5) provided we are able to obtain funds from your payment card. However, we cannot be held responsible for ensuring stock of each specific Product is available at all times or for delays or failures due to adverse weather, traffic delays. mechanical breakdowns or other circumstances beyond our control.Delivery Charges:
6.2.1 Where you placed your Order using the online process for ordering Products via the Website, delivery is free;
6.2.2 Where you placed your Order by calling our Customer Services by telephone on 0845 7078 332, the order will be subject to an additional charge, which will be stated at the time of order.
6.3 Ownership of the Products you Order on the Website shall pass to you on delivery provided that we have processed your card payment and received the full value for such Products.
7. NECTAR
7.1 Sainsbury's is a member of the Nectar rewards scheme and from time to time offers Nectar points on purchases from the Website.
7.2 These will be displayed on the Website at the time you place your Order if you are a Nectar cardholder except where we discover an error in the value of Nectar points allocated to your Products. In this event, JSCL will inform you as soon as possible after receiving your Order and give you the option of reconfirming your Order with respect to the correct value of Nectar points or cancelling it. If JSCL are unable to contact you we will treat the Order as cancelled.
7.3 Sainsbury's will be responsible for the crediting of Nectar points to your Nectar account.
8. CANCELLATION
You may cancel your Order at any time prior to despatch by calling our Customer Help Line on (0845 7078 332) or by emailing us on contactus@sainsburyscontactlenses.co.uk. If you wish to cancel your Order after the Products have been despatched, you will have to return them to us in accordance with the returns procedure set out in condition 9 below.
9. RETURNS
9.1 You may return the Product(s) to our Freepost address below:
9.1.1 If you find a fault with such Product(s) within a reasonable time after delivery provided that we are able to confirm the fault (and in some circumstances, Products may be returned by us to their manufacturer to make such confirmation).
9.1.2 for any reason other than as set out in 9.1.1 above, in its original packaging, unopened and unmarked within 28 days of your Order being despatched. We can only accept returns for the full quantity of products originally despatched.
You must complete the Returns section on the reverse of your Delivery Note, giving a reason for the return. This is important to avoid delay in receiving your refund.
9.2 We will credit your account once the Product(s) has been received by us and has been checked to ensure that the returns policy has been correctly adhered to. Please note that Products cannot be returned to a Sainsbury's store.

10. PRIVACY POLICY
10.1 We will not use the personal data which you provide to us otherwise than in accordance with our Privacy Policy which can be accessed by clicking on the hyperlink at the bottom of every page of the website.
10.2 Your email address is essential in order for us to be able to supply you with important information such as order confirmations, notifications about your prescription expiring and changes to the service. By registering with Sainsburyscontactlenses.co.uk, you accept that your email address may be used to supply you with such information.
11. LIABILITY
11.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or fraudulent misrepresentation.
11.2 In the absence of any negligence or breach of duty by us, your use of any of the Products other than in accordance with their instructions is entirely at your own risk.
11.3 You will be responsible for all liabilities, claims and expenses that arise out of the content you submit, post or transmit via the Website, or from your use/misuse of the Website or the use/misuse by any person for whom you are responsible or from your violation of the Terms.
11.4 JSCL warrants that it will provide the Products with reasonable skill and care, within a reasonable time, and substantially as described in these Terms. JSCL does not make any other promises or warranties about the provision of the Products.
11.5 JSCL cannot assume any liability for:
11.5.1 any viruses or any other disabling features that affect your access to or use of the Website;
11.5.2 any incompatibility between the Website and other websites, services, software and hardware;
11.5.3 any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Website;
11.5.4 any modification, suspension or discontinuance of the Website.
11.6 If either you or we are in breach of the arrangements under these Terms, neither of us will be responsible for any losses that the other suffers as a result, except those which are a foreseeable consequence of the breach. Losses are foreseeable where they could be contemplated by both you and us at the time you place an Order.
12. LINKS & ADVERTS
The Website provides links to third party websites and resources, including links to Sainsburys.co.uk. JSCL has no control over such websites and resources. Therefore, you should ensure that you carefully read the terms and conditions for the accessing and use of such websites and resources and, if you suffer losses as a result of accessing and/or using such third party websites and resources, you must claim against the third party and not us.
13. INTELLECTUAL PROPERTY RIGHTS
13.1 The content of the Website is protected by copyright, trade mark, database and other intellectual property rights. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from JSCL.
13.2 No licence is granted to you in these Terms to use any trade mark of JSCL or Sainsbury's or its affiliated companies.
14. GENERAL
14.1 JSCL shall be under no liability for any delay or failure to deliver Products or otherwise perform any obligation as specified in these Terms if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
14.2 A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. This clause does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.
14.3 These Terms are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
